TERMS OF SERVICE

Pursuant to the Enterprise Law No. 59/2020/QH14 dated June 17, 2020 of the Socialist Republic of Vietnam;
Pursuant to the Information technology Law No. 67/2006/QH11 dated June 29, 2006 of the Socialist Republic of Vietnam;
Pursuant to the Protection of consumer rights Law No. 59/2010/QH12 dated November 17, 2020 of the Socialist Republic of Vietnam;
Pursuant to the E-Transactions Law No. 51/2005/QH11 dated November 29, 2005 and Decree No. 52/2013/ND-CP dated May 6, 2013 of the Socialist Republic of Vietnam;
Pursuant to the Cybersecurity Law No. 24/2018/QH14 dated June 12, 2018 of the Socialist Republic of Vietnam;
Pursuant to Article 38 of the Civil Law No. 91/2015/QH13 dated November 24, 2014 of the Socialist Republic of Vietnam;
Pursuant to the Commercial Law No. 36/2005/QH11 dated June 14, 2005 of the Socialist Republic of Vietnam;
Pursuant to the Decree No. 72/2013/ND-CP dated July 15, 2013 of the Socialist Republic of Vietnam on the management, provision and use of internet services and online information;
Pursuant to the Decree No. 13/2023/ND-CP dated April 17, 2023 of the Socialist Republic of Vietnam on the personal data protection;
Pursuant to other provisions of law related to business activities of digital products and online services;

Article 1. Subjects of regulation:
- People who are allowed to sell and exchange products and services are staffs of Funny Dev Digital Solution Joint-Stock Company and partners licensed to sell products and services (hereinafter referred to as "Salesman" for short).
- People who are allowed to buy software, request to exchange or return products and services, use computers, phones, tablets... to access, shop, and use the Company services and products of Funny Dev Digital Solution Joint-Stock Company with paid fees (products, digital content services) or buy computers, phones, electronic components... (non-digital products and services) at the official stores of Funny Dev Digital Solution Joint-Stock Company (hereinafter referred to as "customer").

Article 2. Who provides products and services:
- Funny Dev Digital Solution Joint-Stock Company (Tax code 5702056524; hereinafter referred to as "Funny Dev., JSC").
- Head office: No 134, group 10, section 2, Trung Vuong ward, Uong Bi city, Quang Ninh province, Vietnam.

Article 3. Products and services content:
- Funny Dev., JSC is the owner and author of the products and services that are sold on Funny Dev., JSC online systems (website, mobile applications) and at the offices and headquarters of Funny Dev., JSC.
- Only the staffs and officers of Funny Dev., JSC who have been trained and licensed to sell, support and warrant products and services, by Funny Dev., JSC and the salesman of Funny Dev., JSC are the ones who are Funny Dev., JSC allowed to sell and support products and services. In addition, no one is allowed to illegally resell Funny Dev., JSC products and services.
- Contents of products and services provided by Funny Dev., JSC include:
+ Digital product and service: A non-existent thing, designed by computer command lines, programming languages, expressed mainly in computer software, websites, and applications mobile and other digital solutions.
+ Products and services other than digital content: Including existing objects (such as computers, phones, electronic components...) and other services in the business field.
- Declaration of exclusive ownership and prohibited copying in any form to the website system funnydev.vn and other extension domain names with prefix funnydev owned by Funny Dev., JSC.

Article 4. The terms and policies of Funny Dev:
- Pursuant to the Terms of Use about products and services of Funny Dev Digital Solution Joint-Stock Company.
- Pursuant to the Policy of Privacy and Secure user information of Funny Dev Digital Solution Joint-Stock Company.
- Pursuant to the Sales and Return of products, services of Funny Dev Digital Solution Joint-Stock Company.
- Pursuant to the Policy of Support of Funny Dev Digital Solution Joint-Stock Company.
- Pursuant to the Policy of Agent and Affiliate of Funny Dev Digital Solution Joint-Stock Company.

Article 5. Principles of buying, selling, exchange, return and refund about products and services:
- Strictly implement the provisions of law stated in the grounds section and other provisions of the law.
- Strictly implement the provisions of terms and policies of Funny Dev., JSC.
- No refund (pay) for digital content products and services (digital product, digital service) since the information on using the product or service (product copyright activation code, source code, translation) services...) are sent to customers via email, customer accounts on the website, via Facebook, Telegram... or directly.
- It is allowed to change to products and services of equal or higher price (extra money) for products and services other than digital content within the first 07 days from the time of purchase of products or services.

Article 6. Customers benefit and allowed behavior:
For customers who have complied with Funny Dev., JSC policies and terms as well as other agreements in the contract, Funny Dev., JSC ensures the maximum benefits for customers including:
- Priority discount, priority service for new products of Funny Dev., JSC.
- Be given priority to become a Funny Dev., JSC collaborator, distributor, and agent and enjoy profits according to regulations.
- Invited to participate in customer appreciation meeting and big events of Funny Dev., JSC.
- Be supported enthusiastically, maximum according to the policy, especially organizing exchange groups, looking for opportunities for business cooperation and economic development.
- Support to use paid products and services without any cost during office hours (from 08:00am to 11:30am and 01:30pm to 5:00pm. UTC+07:00). Outside of this time, Funny Dev., JSC may charge a support fee if necessary.
- Protect personal information, business secrets and support network security solutions.
- Complaints about any behavior affecting customers from Funny Dev., JSC staff and Funny Dev., JSC is committed to thoroughly resolving the complaint immediately.

Article 7. Obligations of customers, prohibited acts:
- Strictly comply with and do not break the policies, terms and other agreements in the contract signed with Funny Dev., JSC to become a customer.
- Strictly comply with the provisions of the law, the State and the Communist Party of Vietnam. It is strictly forbidden to take advantage of Funny Dev., JSC products, services, and images to violate the law, infringe upon the legitimate rights and interests of other individuals/organizations.
- Do not have any "suspicious" behavior (judged by the world leading security mechanisms such as Cloudflare, Google ReCaptcha Enterprise, CSF, Unix Security...) to infringe on property, honor, rights and other legitimate interests of Funny Dev., JSC in cyberspace as well as in real life.
- You are take responsible yourself for the security of personal information if you use easy-to-remember, easy-to-disclose passwords or do not use copyrighted reputable anti-virus software.
- Funny Dev., JSC has the full right to denounce and complain to the Competent Authorities for intentional violations; at the same time have the right to exempt liability, unilaterally terminate the use of products and services and refuse to provide warranty, support for serious violations.

That is the Terms of Use about products and services of Funny Dev Digital Solution Joint-Stock Company which is publicly listed on our websites. So, we would like to announce to all customers.
